Naples Rent Increase Notice Requirement (Update)
In May 2022, the City of Naples proposed an ordinance, similar to Collier County’s, that would require landlords to provide a 60 days’ written notice for rent increases of 5% or more. The Southwest Florida Apartment Association (SWFAA) engaged the Naples City Council to prevent the passage of the ordinance and express the industry’s concerns over the effects it will have.
The city council passed the ordinance on first hearing May 18, and was expected to adopt the ordinance during a second hearing on June 15, but the city staff did not properly advertise the hearing. This caused the second hearing to be pushed back until August 17 where the city council passed the ordinance on final hearing. The city council returned to the second hearing with an updated ordinance where a 15 day notice was included for all leases 15 days or more, but less than 60 days.
The new ordinance, that took effect immediately, will have two sets of notice requirements depending on the length of the lease in question. These changes are expected to cause confusion for housing providers and residents alike, especially when the county has already voted down a similar ordinance. SWFAA made our opposition well known through a letter that was sent to the council and city attorney.
