City of Naples Rent Increase Notification Ordinance

In May 2022, the City of Naples proposed an ordinance, similar to Collier County’s, that would require landlords to provide a 60 days’ written notice for rent increases of 5% or more. The Southwest Florida Apartment Association (SWFAA) engaged the Naples City Council to prevent the passage of the ordinance and express the industry’s concerns over the effects it will have. 

The city council passed the ordinance on first hearing May 18, and was expected to adopt the ordinance during a second hearing on June 15, but the city staff did not properly advertise the hearing. This has caused the second hearing to be pushed back until August for when the city council reconvenes. SWFAA was successful in having the city accept our proposed changes to the ordinance. However, the city council has agreed to move in another direction, asking the city attorney to draft a new ordinance.

The new ordinance will have two sets of notice requirements depending on the length of the lease in question. These changes are expected to cause confusion for housing providers and residents alike, especially when the county has already voted a similar ordinance down. SWFAA will oppose any local ordinance that will create a patchwork of Florida’s already existing Landlord-Tenant Act.
